Terms of Service

These Terms of Service ("Terms") govern your access to and use of QPulse, a live session engagement tool available at qpulse.in, operated by ClanHQ Pvt Ltd ("we", "us", "our"), a company incorporated in India.

By creating an account, starting a session, or joining a session as an attendee, you agree to be bound by these Terms. If you do not agree, please do not use QPulse.

These Terms apply to all users of QPulse including session hosts, session attendees, and any other person who accesses the service.

If you are using QPulse on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

QPulse is a real-time engagement platform that allows hosts to run live polls, word cloud questions, and interactive prompts during meetings, training sessions, townhalls, workshops, and other live events.

Attendees join sessions using a 6-character code from any browser. No app download or account is required for attendees.

QPulse is provided as a software-as-a-service (SaaS) product. We may update, modify, or discontinue features of the service at any time. Where possible, we will give reasonable notice of material changes.

QPulse is intended for professional and organisational use. Common use cases include HR team engagement, L&D training, townhalls, retrospectives, and community events.

To create sessions as a host, you must register for a QPulse account using a valid email address.

You must not share your account with others or allow third parties to access the service using your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms or that appear to be compromised.

QPulse operates on a credit-based model. One credit is deducted when a host clicks "Start Session" and a session goes live.

You agree to use QPulse only for lawful purposes and in accordance with these Terms.

We reserve the right to suspend or terminate your account without notice if we determine you have violated these Terms.

You are solely responsible for the content of the sessions you create, including all questions, response options, and any materials shared during sessions.

You retain ownership of the content you create within QPulse. By using the service, you grant ClanHQ Pvt Ltd a limited, non-exclusive, royalty-free licence to store, display, and transmit your session content solely for the purpose of operating QPulse and delivering the service to you.

We do not review session content before it is published. We reserve the right to remove content or suspend accounts if content violates these Terms, applicable law, or is reported to cause harm.

QPulse, including its name, logo, design, codebase, features, and all associated intellectual property, is owned by ClanHQ Pvt Ltd and is protected by applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in QPulse other than the limited right to use the service as described in these Terms.

You may not copy, reproduce, distribute, modify, create derivative works of, or commercially exploit any part of QPulse without our prior written consent.

"QPulse" and associated marks are trademarks of ClanHQ Pvt Ltd. You may not use our trademarks, logos, or brand names without our prior written permission.

Your use of QPulse is also governed by our Privacy Policy, available at qpulse.in/privacy.

The Privacy Policy explains how we collect, use, store, and protect personal data in compliance with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and the DPDP Rules, 2025.

As a session host, you are responsible for ensuring that you have appropriate legal basis for collecting responses from your session attendees, and that attendees are aware their responses are being collected.

We provide attendee anonymity by default. Hosts must not attempt to circumvent anonymity protections to identify individual attendees through other means.

We aim to provide QPulse with high availability, but we do not guarantee uninterrupted access to the service. Downtime may occur due to maintenance, infrastructure issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. If we discontinue the service entirely, we will provide reasonable notice and offer a pro-rata refund of any unused purchased credits.

QPulse is provided "as is" and "as available" without any warranty of any kind, whether express or implied.

We do not warrant that QPulse will meet your specific requirements. You use the service at your own risk.

Nothing in this clause excludes liability that cannot be excluded under Indian law.

arising from or in connection with your use of QPulse, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to these Terms or your use of QPulse shall not exceed the total amount you have paid to us in the 12 months immediately preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

Nothing in these Terms limits our liability for fraud, wilful misconduct, death, or personal injury caused by our negligence, or any other liability that cannot be limited under applicable Indian law.

You may terminate your account at any time by contacting us at hello@qpulse.in or by using the account deletion feature within the product (where available).

Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply after termination.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms or your use of QPulse shall first be attempted to be resolved through good-faith negotiation. You may contact us at hello@qpulse.in to initiate this process.

If a dispute cannot be resolved through negotiation within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

For consumer disputes, you also have the right to approach the appropriate consumer forum under the Consumer Protection Act, 2019.

We may update these Terms from time to time to reflect changes in our service, business practices, or applicable law.

When we make material changes, we will notify registered hosts by email at least 14 days before the changes take effect and update the "Last updated" date on this page.

Your continued use of QPulse after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using QPulse before the changes take effect.
